and the compensation of the recording and enrolling clerk, andsuch other clerks as may be employed, shall be at such rate asthe chief clerk may agree on, not exceeding three dollars perday: provided, that so much of this section as relates to thecompensation of the principal clerk shall not affect the clerksnow in office.

COMMISSIONERS OF COUNTY.

Section
1. Number of commissioners in eachcounty.—When and how elected andterm of office.
2. Upon first election in new counties,how term of office determined.

4. Vacancy happening before an election,how filled, and for what period.—Ab-sence of commissioner six months va-cates his office.
5. Term of office of those heretofore elec-ted not affected by this act.
6. Commissioners to take an oath, anddeposit a certificate thereof with theauditor.
7. The board constituted a body corpo-rate, to sue and be sued.—Authorizedto sue on subscriptions for publicbuildings and bridges, &c.
8. When and where to hold three ses-sions, annually.
9. To examine public accounts and fundsof county, at June session, and directpublication of exhibit.
10. When they may make contracts inrelation to the public buildings, &c.
11. What contracts for repairs, &c., theymay authorize the auditor to make.

12. In what cases they may compoundfor, or release, a debt, fine, &.C., duethe county.
13. They shall not be concerned in anycontract for the county.—Penaltytherefor.
14. They may administer oaths.
15. They shall provide a place for holdingcourts until buildings are erected.
16. When and how an appeal may be ta-ken and perfected, from their decisionto the common pleas.—Trial and de-cision in court.
17. Commissioner convicted on indict-ment for misconduct in office, shall beremoved and fined.
18. When county commissioners may sup-ply vacancy in office of state roadcommissioners.
19. All prior acts repealed.-—When thisact took effect.
20. When two commissioners are to beelected for different periods, how de-signated.
21. Majority of commissioners shall con-stitute a quorum.
22. They may direct the grade of roadsto be laid, as prayed for by petitioners.
