CONTROVERSY RESPECTING THE NEW HAMPSHIRE GRANTS.

Posse to have proceeded to violence in order to gain the Possession, that the depon 1 believes itcon’d not have been effected & is of opinion tlmt if the attempt had been made, that many of thePosse wou’d have lost their lives, and farther this deponent Saith not.

AFFIDAVIT OF VOLKERT P. DOUW.

City of Albany ss. VolkertJP. Douw of the City of Albany merchant of full age being duly sworndeposeth and saith that Some Time in July last past he this deponent was Summons by Henry TenEyck Esq r Sheriff for the City and County of Albany to assist him in Takinge possession of the houseand Lands that were in the possession of James Brakenridge a| Bennington in the county of Albany that when the Sheriff with the posse proceeded to a Bridge about half a mile from the said house astop was made for some short Time in order to see whether by the persuasion of the Mayor ofAlbany and some other Gentlemen who were Gone to Brakinridge if the could not prevail on himto surrender the possession peaceably as I was informed that upon their return and the SheriffInformed that they would not surrender he ordered the posse to Proceed over the Bridge to the saidhouse that he this deponent then proceeded with the Sheriff to the house and found that not abovetwenty or thirty persons of the posse Attended the Sheriff to the house of Brakenridge the remainderof the posse kept Back at some distance from the house the Sheriff requested of them to cum up tothe house but they did not cum he this Deponent saw a number of peopl who appeared in opposi-tion to the Sheriffs posse had taken possession of a small Ridge North East from the house Andanother party of about twenty or thirty men had the possession of a reising Ground Sout East ofthe house about 200 yards Distance that this Deponent saw the Sheriff knock at the Door anddesire admittance and Acquainted those in the house that he had a writ of possession against thathouse that those that were in the house refused admittance to the Sheriff that the Sheriff orderedthe writ of possession to be read which was accordingly Done that the party Lying Sout East ofthe house when the Sheriff knock at the door presented their Guns at the Sheriff and his party andfurther this Deponent saith not.
