fore the dangers are passed, he shall be received, and thesalary of the fisherman be deducted from that of the pilot,according to the distance he may have conducted the vessel.
Immediately on a pilot boarding a vessel, the masterthereof is obliged to give him the draught of water of suchvessel, under a penalty of liability for all damage if it be12 inches less than the actual draught.
The master shall likewise make known to the pilot thevessel’s rate of sailing, her qualities and defects, that hemay in consequence be able to work the vessel.
The masters of French and foreign vessels shall be at lib-erty to take such pilots as they think fit, to enter into anyport or river without being subject on departing therefromto employ the same pilots.
The masters of vessels and pilots who may be compelledby hurricane or other accident to slip their cables and leavetheir anchors in the roadstead, are obliged to fasten thereto,if possible, buoy-ropes and buoys in good condition, and ca-pable of raising such anchors, and to make a report thereof.
The anchors and cables shall be picked up as soon as theweather may permit, by the pilots, and conducted to thevessels to which they belong if not previously weighed bythe ship’s crew.
Whenever such anchors shall be picked up there shall bepaid for salvage—
If the anchor be without a buoy, one-fourth of the value.
If the anchor be with a buoy, one-sixth of the value.
By foreign vessels:
If the anchor be without a buoy, one-half of the value.
If the anchor be with a buoy, oue-third of the value.
The same to be estimated by surveyors named by thehead-pilot and the master of the vessel.
Pilots shall not exact a greater sum than that mentionedin the tariff-rates drawn up in each port, under penalty ofthe restitution of the entire pilotage.
In cases of tempest and evident danger, an indemnityapart, fixed by the tribunal of commerce, according to thework done and the danger encountered, shall be paid to thepilot by the master.
