8. All such Persons as shall serve on Board Merchant-Ships,With such Commissions ot Marque or Reprizals, are in no 'W ifeto be reputed, ot challenged, as Offenders against the Laws ofthe Land.

g. All Merchants or others, who shall take out such Com-missions, are first' to deliver in Writing - , under their Hands, tothe Lord High Admiral, or to the Lords Commissioners forexecuting that Office, or the Lieutenant, or Judge of the HighCourt of Admiralty, a Specification of the Name, and Burden,of the Ship, with the Captain and Owner’s Names, the Num-ber of Guns and Men she carries, and for how long Time she isvictual’d.

10. Th e Commanders of all such Ships are to hold a regu-lar Correspondence with the Secretary of the Admiralty, andto give an Account of the Designs or Motions of the Enemy'sShips as far as they can discover, or it comes to their Know-ledge ; as also of their Merchant-Ships and Vessels, and whi-ther they are bound, be it out or Home.

11. They are forbid to wear the King’s Colours,commonlyrailed the Union Jack and Pendant ; But then they are allowed,besides the Colours commonly worn by Merchant-Ships, to

a Pendant, together with a Red Jack, with the Uniondescribed in a Canton, at the Upper Corner of it, next theStaff. -

12. They are obliged, upon due and timely Notice giventhem, to conform themselves to all such other Orders and In-structions, as His Majesty shall think fit to direct.

13. It is alst? farther declared to them, that those, who vio-late these Instructions, shall be severely punished, and be oblig-ed to make full Reparation to all Persons injured.

14. Before any Letters of Marque or Reprizals are issued,it is enjoined; that Bail.be given, in the High Court of Admi-ralty, before the Judge thereof, in the Sum of three ThousandPounds, if the Ship carry about One Hundred and fifty Men,aiJ d, if a less Number, Fifteen Hundred Pounds, to make goodan V Damages that shall be done, contrary to the Intent andtrue Meaning of their Instructions, and (in Cafe the whole®f the Prizes is not given to the Captors) to cause to be paid toPsts Majesty, or to such Person as shall be authorized to re-ectve the same, the full Tenth Part of the Prizes, Goods andMerchandizes, according as the fame shall be appraised, as alsoPuch Customs, as shall be due to the Crown.

^When His Majesty, in Council, has approved such aDraught of Instructions and Commission, and the latter hasPEed the Great Seal of the Kingdom, they are registers in the*I*gh Court of Admiralty ; And the Lord High Admiral issues°nt Warrants to the Judge of the said Court, to grant Letters°i Marque or Reprizals, in His Majesty’s Name, and his own,pMer the Great Seal of that Court, who, likewise, annexesthereunto the proper Instructions, and takes Bail, as abovesaid.

.The Lord High Admiral does, likewise, by his Warrant,Mil and require, the High Court of Admiralty, and the Lieu-tenant and Judge of the said Court, as also the Courts of Ad-miralty abroad, to take Cognizance of, and judicially to proceedPpun, all, and all Manner of Captures, Seizures, Prizes, andst-eprizals, of all such Ships and Goods taken from the Enemy,an d to adjudge and condemn all such Ships, Vessels and Goods,Whether they be taken by Ships of War, or by those, which!} a Ve Letters of Marque or Reprizals; As also such other Ves-Ms, or Goods, as may be liable to Confiscation, pursuant tojhp respective Treaties, between His Majesty, and otherPrinces and States; And when the Crown does grant the whole

the Prizes to the Captors, then a Declaration is issued, by-Mich the Shares of the said Prizes is directed to be divided asAllows.

I might naturally here take some Notice of the Laws andCustoms of the Sea, as far as the fame do more immediatelyrelate to the Englijh Nation : But as that would carry me toofar, beyond the Limits I am tied down to, I must defer it ’tilla more-proper Opportunity offers.
