Paix, to fail on the West-side of theIfand, and assault it by Sea, which hecould not have done, bad he gonedown to St. Domingo , or on the South-fide; Because it would have been agreat ffinderance to the TransportShips, which failed very ill, and couldnot so well keep a Wind. (e)

2. Hrs Majesty’s Part of all Prizes at Sea, wasto be divided among the Seamen only, and theBooty at Land, among the Land-Men.

3. But when the Land-men happened to becommanded on Board, upon anyExpedition, or,if in their Passage to the iVef-Indies , the Trans-port-Ships should be engaged, and a Prize taken,such Land-men were to be considered as Sea men,and their Officers on Board to receive a Share, ac-cording to their Pay ; And, in like Manner, theSea-men, and their Officers, when on Shoar, wereto receive a Dividend according to their Pay.

4. That of all Booty taken in Service onShoar, wherein the Commander in Chief of theSquadron, for the Time being, should assist withfour Hundred Seamen, or more, the said Com-mander in Chief was to have the Share alotted toa Colonel, and the Officers appointed by him, tocommand those Men, to be considered as LandOfficers.

5. No Officer of the Militia was to be con-sidered as a Colonel,who commanded less than fiveHundred Men ; Noras a Captain, if he had less,in his Company, than fifty; Unless siach Regimentor Company, should, after their proceeding onthe Expedition, happen to be reduced, by Sick-ness or Accident of War.

Two Thirds of the Booty taken at Land was tobe thus divided.
