Pursuant to this Capitulation, onthe fifth of October, Colonel Nicholsontook Possession of Port-Royal, to whichhe gave the Name of Ænapolis-Royal,and, having, on the tenth, solemnizeda Day of Thanksgiving, for the Successof Pier Majesty’s Arms, appointed Co-lonel Vetch,’ his Adjutant General, inthis Expedition, Governour of the Place;And having, likewise, made other Re-gulations for the Security of this Con-quest, failed, the nineteenth, for Boson,and arrived there, the six and twentiethof the fame Month.

Th e Copy underneath, of a Letterfrom St. John’s, in Newfoundland, mayserve to give the Reader some Idea ofthe Success of Her Majesty’s Ships inthose Parts, this Summer.

Brittain, France, and Ireland, QUEEN, De-fender of the Faith , &c. and Monsieur de Suber-case, Knight of the Military Order of St. Lewis,and Governour and Commander in Chief of theFort of Port-Royal, Province of L'Accadie; andthe Territories thereuntd belonging, for His mostSacred Christian Majesty.

1. That tibe Garrison shall march out withtheir Arms and Baggage, Drums beating, andColours flying.

2. That there shall be a sufficient Number ofShips and Provisions to transport the said Garrisonto Rachel or Rochford, by the shortest Passage,where they shall be furnished with Passports fortheir Return.

3. That I may take out six Guns and twoMortars, such as I shall think fit.

4. That the Officers shall carry out all theirEffects, of what fort soever, except they do agreeto the selling of them, the Payment of which tobe bona fide.

5. That the Inhabitants within Cannon shot of

the Fort of Port-Royal shall remain upon their E-states, with their Corn, Cattle and Furniture, du-ring two Years, in Cafe they are not desirous togo before; They taking the Oaths of Allegianceand Fidelity to Her Sacred Majesty of Great Brit-tain. r , „

6 . That a Vessel be provided for the Privateersbelonging to the Islands in America, for theirTransportation thither.

7. That those that are desirous to go for Pla-centia , in Newfoundland, shall have Leave, by thenearest Passage.

St. John’s (in Newfoundland') Sept. 19.

Most of the French Ships in theseParts are taken off of the Banks, andseveral burnt and destroy’d, with theirHarbours and Fish. ’Tis believed theyhave lost near fifty Sail of Ships thisSeason, and most of them of consider^able Force. Her Majesty’s Ships thePortland and Valeur, had the good For-tune, in their Passage to Newfoundland,to take two very rich Prizes, valued acthirty Thousand Pounds. Some of theGallies have taken Abundance ofPrizes-, But, for our Part, we came inat the latter End, which I hope willturn to good Account; I have here sentyou some Particulars, which cannot butbe acceptable, (p) P. 9. That the Effects, Ornaments, Utensils ofthe Chappel and Hospital, shall be deliver’d tothe Almoner.

10. I promise to deliver the Port of FortRoyal, into the Hands of Francis Nicholson, Esq;for the Queen of Great Brittain, 8cc. withinthree Days after the Ratification of this presentTreaty, with all the Effects belonging to the King,as Guns, Mortars, Bombs, Balls, Powder, andall other small Arms.

11. I will discover, upon my Faith, all theMines, Fougaffes and Caffemats.

12. All the Articles of this present Treaty,shall be executed upon good Faith, without Dif-ficulty, and signed by each other at Her Majestyof Great Brittain a Camp, before Port Royal Pore,this 2d Day of OClober, in the pth Year of HerMajesty's Reign, Annoque Domini, 1710.

SUBERCASE.

Memorandum. The General declared, Thatwithin Cannon Shot of Port Royal, in the fifthArticle abovefaid, is to be understood three Eng-lish Miles round the Fort, to be Annopolis Royal,and the Inhabitants within the said three Miles tohave the Benefit of that Article. Which PersonsMale and Female, comprehended in the said Ar-ticle, according to a List of their Names given into the General, by Mr. Allen, amount to fourHundred and eighty-one Persons.

All the Fish, Oil, Stages, Tram Fatts, Boats, Fishing Tackle, &c. of the abovemention'd Ships,fell into our Hands, and were either taken or destroy’d by us ; And the two Ships which efcap'd lefteven their Anchors and Cables, and some of their Sails behind.
