and set up posts, rails, &c. first making satisfaction to the owners of, orpersons interested in, such lands or grounds, &c. &c. No water to betaken out of the river Irwell into his cut or canal. Power is given tosurvey and set out lands, and all persons empowered to convey suchlands to the duke. But the lands so to be set out shall not exceed sixteenyards in breadth, except, &c. &c. No wharfs to be made between Sal-ford and Barton-bridge, without the consent of the owners of the lands.Commissioners are named to determine differences, &c. between theduke ai)d the proprietors of lands, &c. «Scc. to settle recompenses. Ifparties will not submit to their determination (i. e. of any seven ofthem), refuse to accept the purchase money, &c. or to treat, or shall notagree, juries may be impanelled to assess the purchase moneys, &c.Penalties are 20I. for the sheriff or coroner, 5I. for every juryman andperson summoned who shall make default, to be levied by distress andsale of goods. The commissioners may fettle the proportions of themoneys to be paid to the several persons interested, with an exception.Determinations, verdicts, and judgments, to be kept by the clerk of thepeace; and if the sum given by the jury be greater than that settled bythe commissioners, then the duke to pay the expence of such jury.Upon the payment of the sums assessed, the lands, &c. to vest in theduke; and in default of payment, the sums assessed to be recovered withfull costs of suit by action of debt against the said duke, his heirs, assigns,&c. &c. wherein no essoign, protection, privilege, wager of law, ormore than one imparlance shall be allowed. If costs and damages arenot paid in three months, to be levied on the duke’s coals, boats, &c.The works done in pursuance of this act not to be subject to the sewerlaws. The coals from the duke’s mines not to be fold for more thanfour-pence per hundred weight at Manchester or Salford. Qualifica-tion for a commissioner or juryman 50I. per arm. freehold, or ioool.personal estate after payment of just debts. The duke to fence in thetowing-paths from the adjoining lands, erect bridges, &c. or on neglectthe commissioners to do it, and levy the charges.
