APPENDIX No. XXI r.
APPENDIX No. XXII.
Statement of the Operation of the “ Designs Act 1850,” and “ Protection ofInventions Act 1851,” as far as they concerned the Exhibition.
The “ Designs Act 1850 ” (13 and 14 Viet., cap. 104) enabled ornamental designs anddesigns for shape and configuration as relating to some purpose of utility to bo provisionallyregistered for one year, with a further extension of six months at the discretion of the Boardof Trade. The same Act contained clauses empowering the Government to remit the fees forarticles placed in the Groat Exhibition.
It was arranged that before tho 1st February 1851, such dosigns as wore registered shouldbo subject to the fees, which should bo returned as soon as the articles woro placed in thoExhibition. After the 1st February, registration was granted without fee as soon as thodesign was deposited in tho Exhibition.
Tho Royal Commissioners appointed Captain Ibbotson to watch this department. His dutywas to ascertain whether tho design intended to be registered was actually in tho Building, and whothor the specification agreed with tho article itself. Ho then granted a certificate onthe part of the lloyal Commission that those conditions had been complied with, upon whichcertificate the provisional registration was made gratuitously at the Designs Office at SomersetHouse.
In working tho “ Protection of Inventions Act 1851,” to prevent unnecessary labour beinggono through by the gentlemen appointed by tiro Attorney-General for this purpose, it wasnecessary that a certificate should bo furnishod that tho article was. actually in the Building, and also after tho Exhibition opened, that it had not then boon exhibited, otherwise any patentwould thereby become void.
Certificates to this effect were granted by Captain Ibbotson, and tho number of certificatesapplied for under this and tho Designs Act is given below. Further particulars as to thoworking of tho “ Protection of Inventions Act” will be found in Appendix No. XX11I.
